No students or drivers were reported injured at the time of the incident, officials said. The rear bumper on the bus and the truck’s wheels were damaged in the accident.

Gary Kestner, transportation director for Ohio County Schools, said the truck sideswiped the bus as it was traveling south and the truck was going north on what is known as Strickland’s Turn on Dallas Pike Road near the Ohio-Marshall County line.

Ohio County Schools spokesman Gabe Wells said parents were notified and another bus was brought to the scene to transport the students home.

Wells said the gas truck’s driver was at fault as he reportedly swerved and was cited for being left of center. The Ohio County Sheriff’s Department responded to the scene. However, a report of the accident was not yet available this morning at the sheriff’s office.

Kestner said the bus driver stayed with the children until another bus was brought to the scene.

“When the new bus arrived, the driver proceeded with his route. Another bus had to be put in service to pick up the students missed because of the wreck,” Kestner said.

The article went on to further say that although the accident occurred in Ohio County, Kestner also requested that Dallas Fire Department respond to the scene because that station was closer to the accident site.

“Dallas EMS checked out the students and no one was injured. It was a lot quicker for Dallas as the station was just a couple hundred yards away,” Kestner said.

Kestner, who had driven that bus route for 18 years prior to becoming the transportation director, said the road has always been a concern.

“That turn has always been a pain, even prior to gas drilling,” Kestner said. “This is the first time we’ve ever had a bus involved in something there.”

EZ-Mart convenience store on Highway 183 in Brownwood, TX near the site of a fatal semi truck accident where a pedestrian was killed on May 5, 2011.

Brownwood is located in Brown County, Texas in the central part of the state, about 79 miles southeast of Abilene and about 68 miles nothwest of Killeen.

According to the Brownwood Police Department (BPD), the victim was identified as Martin Francis Augherton, 53 years old, from Brownwood.

BPD officers spoke to the big rig driver, was understandably very upset, but otherwise uninjured. He told them that he was heading south on Highway 183 towards Brownwood, when Augherton appeared “out of nowhere”, crouching on the highway, when he stood up and was struck by the tractor-trailer.

The driver told police that he immediately pulled off the road and ran back to the victim. According to police reports, he immediately called 911 and explained that he was going to drag Augherton off the roadway and onto the shoulder to avoid the two of them being struck by passing cars.

The Early Police Department responded to the scene, along with a trooper from the Texas Department of Public Safety. They arrived to find EMS medics working on “an unresponsive male on the shoulder of the highway.”

According to police, the driver noticed a brown dog lying in the road, which may have been struck by a vehicle prior to this accident; that possibly Augherton was attempting to save, which explained what he believed could have been the reason Augherton was crouching in the road. It was unknown at the time of the report if the dog belonged to Augherton.

The BPD report indicates that there were newly purchased items near the accident site which came from the local EZ-Mart just a short distance away. Police believe Augherton was walking home from the store toward the Wallace Trailer Park nearby.

The truck driver voluntarily agreed to have his blood drawn even though the responding police officer did not feel he was intoxicated.

Justice of the Peace, Brian Thompson, was also on scene did not feel that it was necessary for blood to be drawn from the truck driver.

The National Transportation Safety Board (NTSB)

According to Deborah A.P. Hersman, chairman of the National Transportation Safety Board, fatigue “is one of the most insidious issues in the transportation industry,” and more must be done to fight it, she said.

“We establish a 72-hour prior history in every NTSB investigation,” Hersman said at the National Press Club in Washington Nov. 16. “Unfortunately, we find fatigue in more incidents and accidents than you would think.”

She said the NTSB has recommended the Federal Aviation Administration set hours of service rules for flight crews, aviation mechanics and air traffic controllers, stating it took Congress to change century-old rail employee hours of service rules.

The Federal Motor Carrier Safety Administration, which has issued truck driver hours of service rules three times since 2003, plans to propose a new HOS rule early next year. Read more.
